EU Rules In Apple’s Favour In Tablet Case Against Xiaomi

Xiaomi, a smartphone manufacturer based in China, has been prevented by the General Court of the European Union from registering a tablet computer known as ‘Mi Pad’ since it sounds similar to Apple’s tablet, iPad. According to the EU’s General Court registering the Mi Pad as a trademark would cause confusion among consumers due to the high similarity.

“The dissimilarity between the signs at issue, resulting from the presence of the additional letter ‘m’ at the beginning of “Mi Pad”, is not sufficient to offset the high degree of visual and phonetic similarity between the two signs,” read a statement from the European Union’s General Court.

European Union Intellectual Property Office

An application by Xiaomi to have Mi Pad registered as a trademark in the European Union was filed three years ago with EUIPO – European Union Intellectual Property Office. Soon after a compliant was lodged by Apple with the Cupertino, California-based tech giant arguing that consumers would come to the conclusion that the Mi Pad was related to the iPad. The European Union Intellectual Property Office concurred with Apple in 2016.

The win by Apple in the European Union regarding the iPad trademark coincides with the largest company in the world by market capitalization releasing an iPhone X model which is SIM-free. At the moment the device is available in Apple’s retail store, Apple Store app and Website.

Mobile carriers

Before Apple started selling the unlocked iPhone X model consumers had to get it from Best Buy or Verizon where it was priced at a premium of $100. Alternatively consumers had to make do with a locked model which came with a SIM from either Verizon, T-Mobile, Sprint and AT&T.

To get the unlocked iPhone X on the website of the tech giant, shoppers will have to choose between a CDMA version or a GSM version. The former works with Sprint and Verizon mobile networks while the latter works with T-Mobile and AT&T.

The unlocked iPhone X is aimed at people who travel a lot and regularly and who might need to use different carriers every now and then during their trips. Prices of the unlocked iPhone X start at $999 for the basic model which comes with a storage capacity of 64GB. A model with a storage capacity of 256GB costs $1,149. This comes in the wake of Apple disclosing that its newest operating system for the iPad, iPod Touch and the iPhone, iOS 11, is now installed on 59% of all compatible devices.
